The Freedom of Information Act is a law passed by the Government that gives you the right to request information from public services.  The aim of the act is to promote trust and confidence in our public services, including the NHS, by providing clear information and being open about what we do.

Any individual or organisation can make a request for information.  The Act gives the right to:

• be told if the information exists
• receive the information (unless the information is exempt under the Act).

Publication Scheme

As a result of the Publication Scheme Development & Maintenance Initiative the Information Commissioners Office (ICO) has introduced a model publication scheme and a Health Sector Definition document, which has been adopted by this Trust.

Patient confidentiality

The Freedom of Information Act (FOIA) does not change the right of patients to protection of their patient confidentiality in accordance with the Data Protection Act, common law and Article 8 of the Human Rights Convention. 

Maintaining the legal right to the patient confidentiality continues to be an important commitment on our part.  To help with this, we have appointed someone who is called a Caldicott Guardian. Mr Bruce James, a senior medical consultant, is our Caldicott Guardian who has the responsibility to ensure the protection of patient confidentiality throughout the Trust in accordance with your legal rights.
